These Terms of Use (“Terms”) govern your use of the Colorado Roads & Cameras mobile application (“App”, “Service”) available on Google Play (Android) and the Apple App Store (iOS), operated by Kovan Apps Yazılım Ltd. Şti. (“Company”, “we”, “us”, or “our”).
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of Service
Colorado Roads & Cameras is a free, ad-supported application that provides real-time access to publicly available traffic camera feeds, incident reports, road conditions, mountain pass status, snowplow positions, RWIS road-surface sensor data, variable message signs, travel times, avalanche danger ratings, and weather warnings for the state of Colorado, USA. The App aggregates data from official public sources including the Colorado Department of Transportation (CDOT) through COtrip, the Colorado Avalanche Information Center (CAIC), and the National Weather Service (NWS). Optional Pro subscriptions unlock additional features including unlimited camera groups, home screen widgets, ad-free browsing, and priority alerts.
⚠️ Independent App Notice: This App is an independent, third-party application and is NOT affiliated with, endorsed by, or connected to the Colorado Department of Transportation (CDOT), COtrip, the National Weather Service (NWS), the Colorado Avalanche Information Center (CAIC), NOAA, or any government agency. All data displayed in the App is sourced from publicly available official feeds and is re-presented for convenience.
2. Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent that you meet this age requirement. Users under 18 should use the App only with parental guidance.
3. Safe Use While Driving
🚨 Safety Notice: Do NOT interact with the App while operating a motor vehicle. Viewing traffic camera images, incident details, mountain pass status, avalanche bulletins, or weather information while driving can distract you and pose a serious safety risk. Pull over to a safe location, or have a passenger check the App on your behalf. The App is not a replacement for attentive driving, official traffic signs, posted chain-law signage, or emergency broadcast information.
4. Acceptable Use
You agree to use the App only for lawful purposes. You must NOT use the App to:
- Interfere with, delay, or obstruct law enforcement, emergency services, search-and-rescue, or public safety operations
- Re-broadcast, record, redistribute, or sell camera images, incident data, road condition data, avalanche data, or weather data without authorization from the original data source
- Scrape, mine, or attempt to extract data from the App’s backend in bulk or for commercial purposes
- Reverse engineer, decompile, or attempt to extract third-party API keys or credentials embedded in the App
- Violate any applicable local, state, national, or international law or regulation
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service
5. Data Accuracy and Availability
The traffic, incident, road condition, mountain pass, avalanche, and weather data displayed in the App is sourced from publicly available third-party official feeds. We do not own, control, modify, or independently verify this data. By using the App, you acknowledge that:
- Camera images may be delayed, frozen, or temporarily unavailable due to CDOT system status
- Incident reports, road conditions, snowplow positions, and travel times may be delayed, incomplete, or inaccurate — always defer to live traffic conditions, posted CDOT signage, and emergency broadcasts
- Avalanche danger ratings and zone forecasts are issued by CAIC and are subject to revision at any time
- Mountain pass closure status may lag CDOT’s on-the-ground signage during rapid weather changes
- Weather alerts are fetched from NWS public feeds and may have propagation delays
- Feed availability may vary and is subject to change without notice
- We are not responsible for the content, accuracy, or availability of any data feed
⚠️ Backcountry & Mountain Travel Disclaimer: Do NOT rely on this App as your sole source of information for backcountry travel, winter mountain driving, avalanche risk assessment, or evacuation scenarios. Always follow official guidance from CAIC, local emergency management, the National Weather Service, posted CDOT signage, and authorized broadcast sources. Carry chains and survival gear when traveling Colorado mountain corridors during winter. Dial 911 in a life-threatening emergency.
6. Subscriptions and Payments
The App offers optional Pro subscriptions that unlock additional features. By subscribing, you agree to the following:
Subscription Options
- Pro Monthly: $1.99 USD per month
- Pro Yearly: $9.99 USD per year
Pro Features
- Unlimited camera groups (free tier: 2 groups)
- Ad-free experience
- Priority push notifications (severe traffic, mountain passes, avalanche danger upgrades, winter storm warnings)
- Unlimited mountain pass and avalanche zone watches (free tier: 2 zones)
- Home screen widgets (single camera + multi-camera grid)
Billing
- Payment is charged to your Apple ID account or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- The renewal charge is the same as the original subscription price.
Cancellation
- iOS: Go to Settings → [Your Name] → Subscriptions → Colorado Roads & Cameras → Cancel Subscription.
- Android: Go to Google Play Store → Menu → Subscriptions → Colorado Roads & Cameras → Cancel.
- Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. For assistance, contact Apple Support or Google Play Support.
7. Advertising
The App is free to use and is supported by advertising provided by Google AdMob. By using the App, you consent to the display of advertisements. Ad content is controlled by Google and subject to Google’s advertising policies. We are not responsible for the content of third-party advertisements. Pro subscribers do not see ads.
8. Intellectual Property
The App, including its design, interface, code, logos, and all associated intellectual property, is owned by Kovan Apps Yazılım Ltd. Şti. and protected by applicable copyright and trademark laws. Traffic camera images, incident data, road condition data, avalanche data, and weather data displayed through the App remain the property of their respective source agencies (CDOT, COtrip, CAIC, NWS, etc.).
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove any proprietary notices or labels
- Use the App or its content for commercial purposes without our written consent
9. Third-Party Services
The App integrates with the following third-party services, each governed by their own terms and privacy policies:
- Google Play Services — Core device functionality (Android)
- Google AdMob — Advertisement delivery (Android & iOS)
- Firebase — Analytics, crash reporting, authentication, cloud functions, push notifications, app check, remote config (Android & iOS)
- RevenueCat — Subscription management (Android & iOS)
- Mapbox — Map rendering and tile delivery (Android & iOS)
- Colorado Department of Transportation (CDOT) COtrip — Public traffic camera, incident, road condition, snowplow, RWIS, mountain pass, VMS, and travel-time feeds (CC0 Public Domain)
- Colorado Avalanche Information Center (CAIC) — Public avalanche danger ratings and zone forecasts
- National Weather Service (NWS) — Public weather warnings and alerts
We are not responsible for the practices of these third-party services. We encourage you to review their respective privacy policies and terms.
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:
- Accuracy, completeness, or timeliness of camera images, incident reports, road conditions, mountain pass status, avalanche ratings, or weather alerts
- Uninterrupted or error-free operation of the Service
- Fitness for any particular purpose, including emergency preparedness, backcountry travel, mountain driving, or navigation
- Non-infringement of third-party rights
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOVAN APPS YAZILIM LTD. ŞTİ. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:
- Reliance on any traffic camera image, incident report, road condition, mountain pass status, avalanche advisory, or weather alert
- Any actions taken — including driving, route decisions, backcountry travel, or evacuation timing — based on information displayed in the App
- Interruption or unavailability of the Service
- Loss of data, revenue, or profits
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kovan Apps Yazılım Ltd. Şti. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or violation of any applicable law.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately.
14. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Governing Law
These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms or your use of the App shall be submitted to the competent courts of Ankara, Turkey.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
